Case Study: Deceptive Conduct

We acted on behalf of a Body Corporate in a dispute where an electricity provider had overcharged the electricity to the plaintiff for a decade, incorrectly and knowingly including electricity charges for an adjoining Body Corporate property. When the Body Corporate questioned the invoices, the electricity provider insisted they were correct and were payable by the Body Corporate.

We commenced proceedings against the electricity provider and the other Body Corporate on the grounds of negligence, misleading and deceptive conduct, false and misleading representations and unjust enrichment.

We successfully recovered all of the electricity charges paid by the Body Corporate, and had the incorrect meterage corrected.
