We acted for a retiree who bought a new caravan to travel around Australia to enjoy her well-deserved retirement. Sadly, the caravan was riddled with defects, resulting in 5 separate repairs being needed in a 6 week period. Our client came to us wanting to get her money back, after getting nowhere with the dealership.
We obtained expert evidence which showed that the various defects were unable to be remedied without changing the design and specification of the caravan. We commenced litigation, arguing breach of contract and breaches of the consumer laws. The defendant caved in and we settled for twice as much as our client paid for the caravan in the first place.
